Terms & Conditions of Sale
These Terms of Sale govern the offer and sale of products through the website tiffanyandsienna.com (the “Site”). By placing an order on the Site, you (“Customer”, “you”, “your”) accept and agree to be bound by these Terms, as well as any related policies referenced herein (General Terms of Use, Privacy Policy, Cookies Policy, Returns & Exchange Policy, Membership Terms, etc.).
This website is managed and maintained by Tiffany & Sienna (Private) Limited ("Tiffany & Sienna," "We," "Us," or "Our"), a company incorporated under the laws of Sri Lanka, whose registered address is No 171, Nawala Old Road, Nawala and with registration number PV 003391 40.
1. Business Policy & Customer Eligibility
1.1 We offer products for sale on the Site exclusively to individual customers acting for personal, non-commercial use.
1.2 “Customer” means a natural person buying for personal purposes. If you are purchasing for resale, commercial use, or business purposes, you should not place orders on the Site. We reserve the right to cancel or refuse any order we believe violates this policy.
1.3 These Terms of Sale govern transactions between Tiffany & Sienna and the Customer for products sold directly by us. They do not apply to third-party products or services accessed via external links, banners, or affiliated platforms. For such third-party offerings, separate terms and conditions apply.
2. Ordering & Contract Formation
2.1 To place an order, you must complete the online checkout process on the Site, providing accurate and complete billing, shipping, and contact information.
2.2 An order becomes binding only after we send an order confirmation email. Until confirmation is issued, we reserve the right to accept or refuse orders (for example, due to stock unavailability, payment issues, or errors).
2.3 If we cannot fulfil your order (for any reason), we will notify you and refund any amount paid.
2.4 Before submitting an order, you must review and accept these Terms of Sale and any additional applicable policies (e.g., Returns & Exchange Policy).
2.5 The language of the contract is English, unless otherwise agreed at the time of order.
3. Pricing & Payment
3.1 Prices displayed on the Site are shown in the currency indicated and include applicable taxes or fees (unless otherwise stated).
3.2 Prices, promotions, or offers may change at any time before you complete checkout. The price confirmed in your order confirmation is final.
3.3 Payment must be made using one of the methods offered during checkout (e.g. credit/debit card, bank transfer, other supported gateways). Payment information is processed securely; we do not store full card details, only payment tokens or records necessary for payment completion or refunds.
3.4 Payment must clear before products are dispatched. Until payment confirmation, no binding sale contract is formed.
4. Product Authenticity, Description & Quality
4.1 All products offered are genuine Tiffany & Sienna items, or items sourced from authorised suppliers, we do not sell second-hand, counterfeit or grey-market goods as “new”.
4.2 We strive to ensure all product descriptions (size, material, colour, care instructions) and images are accurate. However, actual appearance (colour shade, texture, fit) may vary depending on device display, lighting, or screen settings. Such variation does not constitute a defect.
4.3 Some items, e.g. limited-edition, signature collection, bespoke/custom pieces, may be marked “Final Sale” or explicitly excluded from returns/exchanges. Product pages will clearly state such exclusions.
4.4 For items eligible for return or exchange, the Product must be returned in original, unused condition, with all tags/labels attached, and within the timeframe specified in our Returns & Exchange Policy.
5. Shipping, Delivery & Risk Transfer
5.1 Shipping methods, costs, delivery timelines and dispatch procedures are described on our Shipping Policy page.
5.2 Once products are dispatched, and handed over to the courier or shipping provider, risk of loss or damage during transit passes to the Customer. We will provide tracking information when applicable.
5.3 Delivery delays or issues resulting from third-party carriers, customs, or external factors beyond our control are not the responsibility of Tiffany & Sienna, though we will assist with available remedies.
5.4 Claims relating to lost, damaged, or missing shipments must be made in writing within the timeframe specified in the Shipping Policy, and must include proof of purchase and any relevant documentation.
6. Returns, Exchanges & Defective Goods
6.1 Returns and exchanges are permitted only for products marked as eligible under our Returns & Exchange Policy.
6.2 Custom, bespoke, or “Final Sale” items are generally excluded from return or exchange unless a manufacturing defect or error was made by us.
6.3 For defective items (material defects, manufacturing errors, incorrect item sent), the Customer must notify us immediately upon discovery and follow the procedure outlined in our Returns Policy. We may offer repair, replacement, refund, or price adjustment depending on the severity and feasibility.
6.4 If a return is conducted through a courier or shipping provider not designated by us, the Customer bears all risk and costs during return transit.
7. Compliance with Sri Lankan Law & Consumer Protection
7.1 As a business operating in Sri Lanka, Tiffany & Sienna acknowledges and commits to abide by applicable legal frameworks governing e-commerce and consumer protection, including the Consumer Affairs Authority (CAA) Act, No. 9 of 2003.
7.2 We adhere to regulatory directives issued by CAA and ensure fair practices at all stages, pre-purchase, purchase, and post-purchase. This includes transparent product information, accurate pricing, clear disclosure of fees and delivery costs, and full consumer rights for valid returns, refunds, or cancellations.
7.3 Online electronic contracts and sales agreements via this Site are legally valid under the Electronic Transactions Act, No. 19 of 2006 (ETA), which supports e-commerce and e-contract enforceability in Sri Lanka.
7.4 We issue receipts or invoices for all completed purchases, including full breakdown (product price, taxes/fees, shipping cost, payment method), in compliance with statutory requirements.
8. Limitation of Liability & Disclaimers
8.1 The Site, its Content, and all services are provided “as is” and “as available.” We do not guarantee uninterrupted availability, continuous operation, or freedom from errors.
8.2 To the maximum extent permitted by law, Tiffany & Sienna disclaims any liability for indirect, special, incidental, or consequential damages, including loss of profit, loss of data, or other economic loss, arising from use of the Site, products, or reliance on descriptions/images.
8.3 Our liability for defective, damaged or non-conforming products is limited to repair, replacement, or refund (as outlined above). We are not liable for ordinary wear-and-tear, misuse, or improper care of products.
9. Amendment of Terms
We reserve the right to amend or update these Terms of Sale at any time (e.g. to reflect changes in business operations, legal/regulatory requirements, or service offerings). Any changes will be published on the Site with a “Last Updated” date. Continued use of the Site after publishing updated Terms constitutes acceptance of the new Terms.
10. Governing Law & Dispute Resolution
These Terms, any sale or purchase contract, and any dispute arising thereof are governed by the laws of Sri Lanka. In case of any dispute, claim or controversy relating to the sale of products, such dispute shall be subject to the exclusive jurisdiction of the courts in Sri Lanka.
